Welcome to Elizabeth Croft Fine Jewelry ("ECFJ," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of www.elizabethcroftfinejewelry.com (the "Site") and any related services, including the purchase of jewelry, custom design commissions, and consultations (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Eligibility

By using the Services, you represent that you are at least 18 years old and capable of entering into a binding contract. If you are using the Services on behalf of another person or entity, you represent that you are authorized to do so.

2. Products and Pricing

  • All product descriptions, images, and specifications are presented as accurately as possible. However, due to the handmade and often one-of-a-kind nature of fine jewelry, slight variations in color, size, gemstone characteristics, and finish may occur.

  • Prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to correct any pricing errors, including after an order has been placed, and will notify you before fulfilling an order at a corrected price.

  • Diamond Sourcing and Traceability. We are committed to sourcing natural diamonds with attention to ethical and responsible practices, and we work with suppliers who adhere to the Kimberley Process and, where applicable, Responsible Jewellery Council (RJC) Code of Practices. Center stones and other diamonds of sufficient size are, where available, accompanied by individual grading and/or traceability documentation from accredited laboratories (such as GIA) and/or supplier chain-of-custody documentation, which may be provided upon request. Melee and pavé diamonds (generally those below a size threshold at which individual laboratory grading is standard practice) are sourced from suppliers who provide sourcing assurances at the batch or supplier level rather than per-stone certification, consistent with standard practice across the diamond industry. The absence of an individual certificate for a melee or pavé diamond does not indicate a lack of due diligence in its sourcing.

3. Custom and Made-to-Order Pieces

By commissioning a custom piece, you acknowledge and agree to the following:

  • Deposits. Custom orders typically require a non-refundable deposit to begin work, with the balance due prior to completion or delivery. Specific deposit amounts and payment schedules will be communicated to you in writing before work begins.

  • Lead Times. Estimated production timelines will be provided at the time of order but are approximate and may vary depending on materials, sourcing, and design complexity. Should a piece require longer than the originally estimated lead time, we will notify you as soon as reasonably possible with an updated timeline. Delays of this nature do not entitle the client to cancel the order or receive a refund of any deposit or payments already made.

  • Approvals. Custom designs may involve sketches, renderings, or wax/CAD approvals at various stages. Once a design is approved by you in writing (including via email), changes requested after that point may incur additional costs and extend the timeline.

  • Cancellations. Due to the bespoke nature of custom work, cancellations after a deposit has been paid or after materials have been sourced may not be eligible for a refund of the deposit or costs already incurred.

4. Payment

We accept payment through the methods made available on the Site at checkout. By providing payment information, you represent that you are authorized to use the payment method provided and authorize us (or our payment processor) to charge the applicable amounts, including taxes and shipping, to that payment method.

5. Shipping and Risk of Loss

  • We take care to securely package and insure shipments of fine jewelry. Shipping methods, timelines, and costs will be provided at checkout or communicated directly for custom orders.

  • Risk of loss and title for items purchased pass to you upon our delivery to the carrier, unless otherwise stated.

  • You are responsible for providing accurate shipping information. We are not responsible for delays, loss, or mis-delivery resulting from inaccurate address information.

6. Returns, Exchanges, and Warranty

  • Ready-to-Wear Pieces (Under $75,000). Items may be returned for a refund within 14 days of delivery, provided they are in their original, unworn condition with all original packaging and documentation intact.

  • Ready-to-Wear Pieces ($75,000 and Over). Due to the high value of these pieces, items priced at $75,000 or more are eligible for exchange only within 14 days of delivery, provided they are in their original, unworn condition with all original packaging and documentation intact. These items are not eligible for a refund.

  • Custom and Made-to-Order Pieces. Because these pieces are made specifically for you, they are final sale and not eligible for return, exchange, or refund, except in cases of manufacturing defect.

  • Repairs. We accept repairs only for pieces originally purchased from Elizabeth Croft Fine Jewelry. Pieces purchased elsewhere are not eligible for repair through us. If your ECFJ piece requires repair outside of the warranty described below, please contact us to discuss options.

Limited Warranty

We stand behind the craftsmanship of every piece. For 1 year from the date of delivery, we warrant that your piece is free from defects in materials and workmanship, such as a failed setting, faulty clasp, or similar manufacturing defect. If a covered defect arises within this period, we will repair or replace the piece at no cost to you.

This warranty does not cover damage resulting from normal wear and tear, accidents, improper care or storage, alterations or repairs performed by anyone other than us, or loss or damage to gemstones resulting from impact or wear (e.g., a loosened or chipped stone from daily wear is not considered a manufacturing defect).

Complimentary Resizing. Engagement rings are eligible for complimentary resizing at any time, subject to the limitations of the piece's design (some designs, such as eternity bands or pieces with certain stone settings, may have limited resizing ranges or may not be resizable).

For all other ring purchases, the first two sizings within 12 months of the original purchase date are complimentary, subject to the same design limitations noted above. Additional sizings, or sizings requested after this period, may be available for a fee.

7. Intellectual Property

All content on the Site, including text, graphics, logos, images, designs, and the ECFJ name, monogram, and brand assets, is the property of Elizabeth Croft Fine Jewelry or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

Custom designs created for clients remain subject to our design rights unless otherwise agreed in writing; clients receive the physical piece but not necessarily the right to reproduce the design.

8. User Conduct

When using the Services, you agree not to:

  • Provide false or misleading information.

  • Use the Services for any unlawful purpose or in violation of any applicable laws.

  • Attempt to interfere with, compromise, or disrupt the security or functionality of the Site.

  • Use the Site to harass, abuse, or harm another person.

9. Disclaimers

The Services and all content are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the fullest extent permitted by law, ECFJ and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Services, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the Services shall not exceed the amount you paid for the applicable product or service.

11. Indemnification

You agree to indemnify and hold harmless ECFJ and its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the Services or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Illinois, and you consent to the jurisdiction of such courts.

13. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by an updated "Last updated" date, and your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.
